Terms and Conditions
LEAD TIME TO SHIP: The lead time to ship is subject to material availability and inventory levels, and the “Product” will ship accordingly from Cascade TEK Solutions, Inc. or as stated on previous page(s) of this price quotation. Inventory levels are subject to change. Options effect lead time.
DELIVERY TERMS: Ex Works (EXW) Cornelius, Oregon, USA, unless otherwise agreed.
VALIDITY: This product quote is valid for 60 days or as otherwise noted in the quote. Freight quotes are for reference only, and might change after 30 days or if the shipping variables change before shipment.
FREIGHT CHARGES: The default PrePaid and Added (PPA) freight charges quoted above are for dock-to-dock for domestic shipping, and dock to either ocean port or airport when international, and will be charged on your invoice. If additional services are required, such as inside delivery, lift gate truck, customs cleared, inland or on-carriage, or other accommodations, please specify this when placing your order for a revised quote. If these requirements are not stated at the time of freight quotation, the quote is invalid and additional charges will apply after shipment. Any related surcharges are passed through at cost. Failure to provide a valid address, contact name, or contact information that impedes delivery will result in additional charges.
PRICES: All prices are quoted in USD and are effective at the time of publication. Any price changes (incl. surcharges, customs and duty tariffs or similar) are subject to change without notice.
PAYMENT TERMS: All prices are in U.S. Dollars
• Domestic and Canada: ACH, major credit cards (not sent via email), other pre-payment, or depending on your credit application approval up to 30 Days Net of invoice date.
• International: Irrevocable Letter of Credit (L/C) confirmed on a U.S. bank with all charges to the buyer account and payable at sight or as mutually agreed.
• A 20% deposit is required on all orders over $50,000.00 in value, unless otherwise agreed or specified in the previous quote.
• A late fee of 1.5% per month (18% annual) on all amounts that are past due.
DOCUMENT CONTROL STATEMENT: For any item on the Commerce Control List being exported, these items are controlled and authorized by the U.S. Government for export only to the specified country of ultimate destination for use by the end-user herein identified. They may not be resold, transferred, or otherwise disposed of, to any other country or to any person other than the authorized end-user or consignee(s), either in their original form or after being incorporated into other items, without first obtaining approval from the U.S. government or as otherwise authorized by U.S. law and regulations.
EQUIPMENT SITE CONDITION: This quotation is based upon the assumption that your site is suitable for placement and operation of the equipment being quoted. This includes proper electrical supply, ventilation, drainage, water source, height and width requirements, open doorways for access to site and ambient conditions. Any work required preparing the site for proper placement and operation of the equipment shall be the responsibility of the buyer. Any delay in requested or scheduled delivery or shipment due to site conditions is the responsibility of the buyer and may require payment by or charges to the buyer.
LIMITED WARRANTY: Cascade TEK Solutions, Inc. (“Manufacturer”) provides a LIMITED WARRANTY ONLY, which is available for Domestic and international shipments.
CLAIMS: Any and all claims for errors in merchandise must be made in writing immediately upon receipt of equipment. All returns must be pre-authorized by Cascade TEK Solutions, Inc. and require a “Returned Materials Authorization” (RMA) issued by Cascade TEK Solutions, Inc. for the specific serial number(s) being returned. No credit will be allowed on returned equipment without Cascade TEK’s pre-approval and permission. It is expressly agreed that the buyer’s sole and exclusive remedy for any claims arising under this agreement against Cascade TEK Solutions, Inc. shall be limited to return of the goods and repayment of the purchase price, or replacement of the equipment by Cascade TEK Solutions, Inc. The buyer is liable for all the costs and expenses of return of the goods in cases that are due to buyer order error.
RETURN/REPAIR INQUIRIES: Return authorizations of qualified products are only allowed within 30 days of the ship date. A restocking fee of 25% will apply to all items being returned in addition to shipping to and from Cascade TEK Solutions and its subsidiaries. Goods damaged as a result of shipping cannot be returned. Use care when returning items. Any damage as a result from customer improper packaging will not be accepted for return. Before returning any product, you must contact the Cascade TEK Solutions Support Department at (888)-835-9250 to obtain a Return Authorization Number (RA).
• Custom products cannot be cancelled or returned.
• Filters, regardless of condition, cannot be returned.
Please have the following information available when calling Cascade TEK Solutions Customer Support:
• Model number
• Serial number
• Contact phone number
• Description of the problem with the unit or reason for return
• Current Photos of the Unit
• The RA number must then appear on the packing slip of the returned package to avoid delays.
FREIGHT DAMAGE CLAIMS: Freight damage must be reported to a Cascade TEK Solutions customer support representative within 5 days of product delivery by calling (888) 835-9250. Visible damage must be documented on the delivery receipt and include both consignee signatures at the time of delivery to file a claim. Please have the following information available when calling to report freight damage.
• The original (signed) delivery receipt with damage documentation noted.
• Additional substantiating documents e.g. Photos, employee statements etc.
If the above conditions are not met Cascade TEK Solutions may not be able to repair or replace your product.
QUOTATION AND ACCEPTANCES: All quotations are subject to prior sale, and changes may be made without notice. Terms of the proposal shall be accepted by the buyer’s issuance of a Purchase Order within the offer period as stated in this price quotation. By the issuance of a Purchase Order, the buyer assents completely and exclusively to the terms and conditions herein. All proposals and acceptances of orders are made with the mutual understanding that orders are not subject to cancellation. This agreement shall be considered an Oregon contract and shall be interpreted and administered for all purposes under the laws of the State of Oregon, USA.
REMEDIES: Buyer acknowledges that the seller only transacts business in the State of Oregon and that if any dispute arises from this transaction, buyer expressly waives any right to assert the jurisdiction of said matter in any other forum. Buyer waives the right to claim damages, fees, costs, or any combination thereof, which may be statutorily allowed by such other jurisdiction. All costs of collecting past due payments, including reasonable attorney’s fees, shall be borne by the buyer.
GENERAL: This agreement is deemed effective upon execution and delivery of the buyer’s purchase order and seller’s acceptance thereof. Care is taken to give reliable descriptions, but these are not guaranteed and prospective purchasers are advised to check relevant details, including size, operating range, equipment inclusions such as shelves, accessories, installation and other services, and all other details relevant to the buyer’s use of the equipment. Cascade TEK Solutions, Inc. reserves the right to correct any stenographic error, or incorrectly listed, printed or quoted descriptions. Any contrary clause contained in the customer purchase order shall not be considered as part of the conditions of sale.

Limited USA Warranty Policy
Cascade TEK Solutions, LLC. warrants products sold for a period of two years against defects in material or workmanship as follows: Cascade TEK Solutions, LLC., at its option, unless otherwise agreed, will replace or repair any defective product unit or defective part of the product unit at no charge, or refund the purchase price to purchaser, provided that:
- The warranty claim is made in writing within the period of two years; and
- The proof of purchase by bill of sale or receipted invoice is submitted concurrently with the claim and shows that the product is within the applicable warranty period to Customer Service of Cascade TEK Solutions, LLC.; and
- The purchaser complies with Procedures for Returns listed under the General Terms and Conditions contained herein; and
- The purchaser complies with all the manufacturer’s requirements.
The warranty is in force from the date of shipment from the manufacturing facility of Cascade TEK Solutions, LLC. The warranty period begins on the day the customer receives the product, but not later than 45 days after the date of shipment from Cascade TEK Solutions’ manufacturing facility. Cascade TEK Solutions, LLC reserves the right, at its discretion, to fulfill warranty claims with refurbished or reconditioned parts or units.
This warranty shall not apply to:
- a) Defects or damages resulting from (1) misuse of the product, (2) use of the product in other than its normal and customary manner, (3) accident or neglect, (4) improper testing, operation, maintenance, service, repair, installation, or storage, (5) unauthorized alteration or modification, (6) damage determined to be the result of freight or shipping after the product has left the factory; or
- b) Normal tear and wear of the product, its components, or parts; or
- c) Post-expiration dated material
- d) Cascade TEK Solutions, LLC reserves the right, at its discretion, to refer customers to component manufacturers for fulfillment of warranty obligations given by manufacturers other than Cascade TEK Solutions, LLC on individual components or parts in any product manufactured by Cascade TEK Solutions, LLC.
- e) Any Transfer of Ownership from the Original End-user Owner.
Other limitations
This warranty is the exclusive remedy of the purchaser, and Cascade TEK Solutions, LLC. disclaims all other warranties, whether express, implied or statutory, including without limitation, warranties of merchantability and fitness for particular purpose. No employee, agent, or representative of Cascade TEK Solutions, LLC. is authorized to bind Cascade TEK Solutions, LLC. to any other warranty. In no event shall Cascade TEK Solutions, LLC. be liable for incidental or consequential damages.
All express and implied warranties, including the implied warranty of merchantability and the implied warranty of fitness for a particular purpose, are expressly disclaimed and shall not apply to any products sold or services rendered hereunder. Cascade TEK Solutions, LLC. shall not be liable for consequential, incidental, special, or other direct or indirect damages resulting from economic loss or property damage sustained by you or any end user from use of the products sold or services rendered hereunder.
RETURN POLICY of Customized Products and Standard (Non-Modified) products
Cascade TEK Solutions LLC does not accept any returns of customized products that have been designed per user specifications. For standard, non-modified, products, CASCADE TEK SOLUTIONS, LLC. reserves itself the right, with three-month notice, to modify conditions under which Cascade TEK Solutions products can be returned and refunded. If the product was purchased through a dealer or third-party representative, the product return must be arranged in conjunction with the seller: (1) the product must be unused; (2) a return material authorization number (RMA) has been issued by Cascade TEK Solutions, LLC.’s customer service department within 60 days after the shipment; (3) Cascade TEK receives the returned product at the factory in Cornelius, Oregon within 90 days after issuance of the return material authorization number and (4) the product must be returned in Cascade TEK packaging. If the packaging has been damaged or discarded, Cascade TEK will forward new packaging at the customer’s expense. (5) All return freight charges are the responsibility of the customer unless it is a case of pre-approved replacement, and (6) a credit will be issued when the product has arrived at Cascade TEK Solutions, LLC. and has been inspected by Cascade TEK to be suitable to be returned to stock. (7) Cascade TEK Solutions, LLC. will charge a 25% restocking fee on all returned products that will be deducted from the return credit. In a case of restocking costs being higher than 25%, Cascade TEK will deduct the higher amount from the return credit.
RETURN POLICY of Customized and Private Label products
Cascade TEK Solutions, LLC. does not accept any returns of customized products. Products made by Cascade TEK Solutions, LLC. that are sold under other brand names will be handled according to mutual agreements and legal requirements.
Limited International Warranty Policy
Cascade TEK Solutions, LLC. warrants products sold against defects in material or workmanship as follows: Cascade TEK Solutions, LLC., at its option, unless otherwise agreed, will replace any defective product unit or defective part of the product unit at no charge, or refund the purchase price to purchaser, provided that:
